A 16-year-old girl faces child porn charges for sending her friends a video of herself giving oral sex.

The girl, identified as SK by court documents because she is a minor, sent the video to two friends in October 2016.

According to court documents, the three friends, identified as KS and AT, would regularly exchange “silly” videos and attempted to “outdo” one another.

After the three friends had a falling out, AT and KS showed the video to an officer at the Charles County Sheriffs Office.

Only SK faces charges related to the video even though one of her friends reportedly shared the video while they were in school, prosecutors said.

Once the video got out, SK did not attend school for a month, according to court records.

She recently appealed the charge after the Special Court of Appeals upheld her child pornography conviction, ruling that it is not illegal for a 16-year-old to engage in sex, but it is illegal for them to send a video of the act.

The court wrote: The First Amendment to the United States Constitution did not protect conduct of a minor who distributed a digital video file of herself engaged as a subject in consensual sexual conduct.

SKs lawyer, Claudia Cortese, argued that the law, which is intended to protect children, is being used to harm her client, who was put on probation and referred for a mental health evaluation.
