NEW DELHI: The National Consumer Disputes Redressal Commission (NCDRC) has ordered state-owned NBCC to pay Rs 2 lakh for rental loss to a flat buyer who got his house after a delay of nearly 39 months.
"We are of the considered view that there is deficiency of service on the part of NBCC and this complaint is allowed in part directing NBCC to pay interest at 10% per annum on the amount deposited by the complainant from June 2015 till the actual date of possession which is in August 2018. This together with compensation of Rs 2 lakh for rental loss and mental agony and costs of Rs 25,000," said the order passed by a two-member bench of NCDRC comprising its president Justice R K Agrawal and member M Shreesha.
The order passed on Friday directed NBCC to comply within four weeks, failing which it would have to pay 12% annual interest for the same period.
One Shriram Trivedi of Ramesh Nagar in Delhi had booked a flat in NBCCs housing project in Sector 89 in Gurgaon in 2012 at a cost of over Rs 1 crore. NBCC had promised to deliver the flat by June 2014. When Trivedi visited the site in September 2014, he did not see any major progress. In an RTI reply, NBCC in May 2014 admitted that work had stopped from January 2014.
