SRINAGAR: The J&K high court has fixed November 7 to hear the habeas-corpus petition of an alleged cancer patient, who has been detained under the stringent Public Safety Act (PSA) since August 6 and thrown into a jail in Uttar Pradesh.
The court has issued notices to the government twice since the petition was filed by south Kashmir's Kulgam resident Parvez Ahmad Palla, 33, soon after he was detained under PSA. The authorities have failed to file a reply to the petition challenging the detention of Palla.
According to the petition, Palla is on "life-saving drugs" as he is suffering from "papillary thyroid cancer". Even hospital records show Palla was registered with the Department of Nuclear Medicine of the Sher-e-Kashmir Institute of Medical Sciences (SKIMS), Soura, as a case of papillary cancer thyroid and had also received high doses of therapy for the same in the past.
After Palla's parents moved the HC on his behalf, their petition first came up before a single-judge bench of Justice Sanjeev Kumar on August 30. Justice Kumar issued notices to the government respondents, directing them to file a reply by September 23.
When the matter came up in the HC on September 23, the court asked the government lawyer about their reply. The government counsel, however, sought some more time to file the same. The court then ordered the government to file the reply by November 7 and fixed that date for the next hearing, petitioner's lawyer Wajid Ahmad said.
