The wife of actor Alok Nath (62) has submitted a complaint before a magistrates court, seeking that an FIR be registered against writer-producer Vinta Nanda for allegedly defaming her husband. In a social media post last week, Nanda had accused Alok Nath of sexually assaulting her nearly 19 years ago.

Ashu Nath, through lawyer Ashok Saraogi, submitted a complaint before the additional chief metropolitan magistrates court in Andheri on Friday, seeking that a written complaint submitted to the Amboli police station earlier by her husband against Nanda be converted into an FIR and the matter be investigated.

“This incident had taken place 19 years ago. She has made allegations of a serious nature against my client. Why would anyone who may have gone through such a traumatic incident not approach the authorities earlier? There is a due process of law and it is not right to just name someone on social media and harm his reputation. Hence, a letter was given to the Amboli police on Friday to register a case under sections 499 and 500 of the IPC that deal with defamation,” Saraogi said.

He added, “However, as it is a non-cognizable offence for which the police will eventually need permission of the court to investigate, we have approached the court. We have sought that the Amboli police be directed to take cognizance of our complaint and investigate the matter.”

In the complaint, Ashu has said: “…it is matter of record that recently, at USA, a campaign had been started in the name of #Me Too and accordingly, some of the artists in the film Industry along with others have joined the said campaign by way of alleging that during the shoots or during the career in the film Industry, they have been sexually assaulted.”

“The complainant states that accordingly, the accused had posted a news on the social media without naming the husband of the complainant. However, she has accused him of having committed a rape with her about 19 years back…The complainant states that the said matter had been widely published by all newspapers along with TV channels and during the said process, the accused has also started abusing the complainant by making unwanted allegations against the complainant,” it added.

Asking that a case of defamation be registered, the complaint stated: “The complainant states that because of the said defamatory statement published on behalf of the accused by way of interviews given to various such social media, the position of the complainant and her husband is such that they were terrorized as even if they move out, the people are looking at them with a different attitude. In view of the aforesaid facts, it becomes crystal clear that the accused has committed an offence under the provisions of sections 499, 500 of IPC.”
