MUMBAI: Providing relief to doctors, the national consumer commission recently dismissed a medical negligence complaint against a doctor couple and held that frivolous complaints demoralise doctors and deter them from fearlessly providing services to society.
The commission said complaints against doctors under the Consumer Protection Act have been on the rise and many of them are frivolous. “This Act is not meant to be a tool to obtain wrong gains or to create nuisance value for medical professionals,” a single member bench of Dr S M Kantikar said.
In the complaint submitted before the National Consumer Disputes Redressal Commission, pharma company owner Bhushan Jain alleged that in January 2017, his wife suffered a heart attack and died. He alleged that Dr Chandru KM had treated her for sore throat and fever, but did not alert them about a heart-related condition. Chandrus wife is a co-accused.
